We know you are eager to get started enjoying the feeling of empowerment with other Planet Pilots -but before we can start, first a few words about privacy and protection of your data online.

We at Planet Pilots are committed to protecting and respecting the privacy and online safety of every child, parent, teacher, and other users and members of platforms and services provided by Planet Pilots.

Terms of Service

'Planet Pilots' provides its services (described below) to you through its website located at https://planetpilots.org (the “Site”), through https://empowermenthub.planetpilot.org (the “Empowerment Hub”) and through its mobile applications and related services (collectively, such services, including any new features and applications, and the Site, the “Service(s)”), subject to the following Terms of Service (as amended from time to time, the “Terms of Service”). We reserve the right, at our sole discretion, to change or modify portions of these Terms of Service at any time. If we do this, we will post the changes on this page and will indicate at the top of this page the date these terms were last revised. We will also notify you, either through the Services user interface, in an email notification or through other reasonable means. Any such changes will become effective no earlier than fourteen (14) days after they are posted, except that changes addressing new functions of the Services or changes made for legal reasons will be effective immediately. Your continued use of the Service after the date any such changes become effective constitutes your acceptance of the new Terms of Service.

PlanetPilots.org and Planet Pilots are names of brands and services currently incubated by Educatefor.Life and operationally delivered by the legal entity Lanwei Group Holdings Limited, a private limited company in Hong Kong that builds exponential organizations for the benefit of humanity. Planet Pilots expect to become an independent, legal entity within 12-24 months. All registered users will be notified in advance of any changes that may happen to the terms of service and to the privacy policies.

Please read these Terms of Service carefully, as they contain an agreement to arbitrate and other important information regarding your legal rights, remedies, and obligations. The agreement to arbitrate requires (with limited exception) that you submit claims you have against us to binding and final arbitration, and further (1) you will only be permitted to pursue claims against Planet Pilots on an individual basis, not as a plaintiff or class member in any class or representative action or proceeding, and (2) you will only be permitted to seek relief (including monetary, injunctive, and declaratory relief) on an individual basis.

When using certain aspects of the Services or using certain Services, you will be subject to any additional terms applicable to such services that may be posted on the Service from time to time, including, without limitation, our Privacy Policy, Code of Conduct (created and maintained by the Planet Pilots who are members), and Teacher Guides. All such terms are hereby incorporated by reference into these Terms of Service.

The Services consist of an online platform (Empowerment Hub) through which Children (the Planet Pilots) from age of 8 years old engage in self-directed, fun, empowering activities and projects where they can request mentoring or help in the facilitation of sessions from more experienced Planet Pilots or other members of the Empowerment Hub. The typical main cycle of each Planet Pilot is illustrated below.

Parents can purchase a monthly membership for their Child, which gives all family members living at the of the same household access to the Empowerment Hub and all activities that are included in the membership. 

Teachers and their school (or other types of organization) can purchase a monthly membership for their students, which also will give all family members of the household of each Student access to the Empowerment Hub and all included activities.

Key Terms

User” “you” or “your” means a person, organization or entity using the Services, including Parents, Teachers and Mentors.

“Parent(s)” means a parent or legal guardian who completes Planet Pilots’s account registration process to purchase memberships on the Site for the purpose of enrolling their child.

“Teacher(s)” means a person who completes Planet Pilots's account registration process to enroll their student(s) on the Site,

or a Partner organization that executes an agreement with Planet Pilots to offer and deliver advice, mentoring, guidance, facilitation or other service/activity on the Site. 

"Mentor(s)" means a person who makes personal experience and interest in mentoring others on their personal "Hero's Journey".

Access and Use of the Service

 

Services Description: Planet Pilots’s Service is an online Empowerment Hub, designed to empower Children the age of 8 to 15 years old in their individual and collective co-creation and their journey to accomplish their own goals. You may join also if you are younger than 8 or older than 15. We do have 6-7 year old Planet Pilots too. If you are above 15 (or even below), then you may be excited about mentoring younger Planet Pilots and we also have partners who do exciting activities for your age group that you can join (often at no extra charge).

 

Parents can connect with each other in Parents' Hangouts, for example, to discuss ways of empowering children and to discuss how to best support the activities and personal development of their children. Teachers can access the Empowerment Hub to stay informed about projects and activities and to assist us in keeping the Empowerment Hub a safe, fun, and welcoming space for everyone, from all backgrounds, beliefs, and locations across all pillars of diversity.

 

As the provider of the Empowerment Hub, Planet Pilots (as a legal entity) does not own, create, sell, resell, control, or manage any of the projects started and handled by Planet Pilots (the Children). Planet Pilots' responsibilities are limited to: (i) providing the Site as an online platform, and (ii) lead the continuous development and documentation of impactful ways of empowering children (which can include projects run by Planet Pilots as a legal entity). The responsibilities of Planet Pilots also include Quests that are facilitated by Planet Pilots without any external partners.

 

There are risks that you assume when dealing with other Users (including those who may be acting under false pretenses). While Planet Pilots strives to provide a safe and welcoming environment for its Users, you agree that all of these risks are ultimately borne by you, and not Planet Pilots.

 

Whilst we do application screenings and maintain a code of conduct to secure a respectful behavior of Users and we do our uttermost best to guarantee the quality of the activities,
Planet Pilots cannot guarantee the authenticity, quality, safety, legality, or appropriateness of the activities. 

 

Many events and sessions have a Facilitator or Observer to help manage situations. Some activities are taking place fully autonomously and without an official Facilitator being present. This is especially the case for local hangouts and small project teamwork sessions. 

We are core believers in allowing for screened and approved members to take place in or organize fully autonomous activities without the need for an official facilitator to be present. 

When a situation between Planet Pilots or visitors do not meet the expected standards in these areas, Planet Pilots Core Team may initiate an examination which includes interviewing the involved parties, reviewing log files (chat logs or similar) and take other action to take appropriate action to resolve a situation and prevent it from happening again if possible. 

Your Registration Obligations: You will be required to register with Planet Pilots in order to access and use certain features of the Service. If you choose to register for the Service, you agree to provide and maintain true, accurate, current, and complete information about yourself as prompted by the Service’s registration form. Registration data and certain other information about you are governed by our Privacy Policy. You must be of legal age to form a binding contract to register for the Service (in many jurisdictions, this age is 18). If you are not yet of legal age to form a binding contract, then you must get your Parent to read these Terms of Service and agree to them for you before you use the Service. If you are a Parent and you provide your consent to your child's use of the Service, then you agree to be bound by these Terms of Service with respect to your child’s use of the Service.

 

Member Account, Password and Security: You are responsible for maintaining the confidentiality of your password and account, if any, and are fully responsible for any and all activities that occur under your password or account. You agree to (a) immediately notify Planet Pilots of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session when accessing the Service from publically accessible devices. Planet Pilots will not be liable for any loss or damage arising from your failure to comply with this Section.

Modifications to Service: Planet Pilots reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Planet Pilots will not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

General Practices Regarding Use and Storage: You acknowledge that Planet Pilots may establish general practices and limits concerning use of the Service, including without limitation the maximum period of time that data or other content will be retained by the Service and the maximum storage space that will be allotted on Planet Pilots's servers on your behalf. You agree that Planet Pilots has no responsibility or liability for the deletion or failure to store any data or other content maintained or uploaded by the Service. You acknowledge that Planet Pilots reserves the right to terminate accounts that are inactive for an extended period of time. You further acknowledge that Planet Pilots reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.

 

Planet Pilots does not store credit card information. Credit card information is stored by Stripe.com, which is the secure processing partner integrated to the PlanetPilots.org website. Other payment processors used by Planet Pilots are Paypal.com and Alipay.com (these payment options are not offered to all users). If you choose these alternative payment processors when paying on PlanetPilots.org, you accept that your payment information is stored by the chosen payment processor.

 

Activity Recordings: Activities such as Hangouts, Quests and other activities that take place through Planet Pilots's video platform may be recorded by Planet Pilots (“Recordings”). We value student and Teacher privacy, and our use of Recordings is extremely limited. Specifically, Recordings are made available only to the Members participating and for assessing quality of service or investigation in complaints of inappropriate behavior or misuse of services. Planet Pilots may use Recordings to provide feedback to participants in activities, to improve our Services, for customer support, and for compliance purposes. Planet Pilots retains Recordings of activities for a certain period of time after which they are deleted. Our Privacy Policy describes this in detail. Notwithstanding the foregoing, Planet Pilots will also delete Recordings earlier than the default period under the following circumstances: (a) upon the request of a Parent for the deletion of their child’s personally identifiable information, or (b) upon the reasonable determination of Planet Pilots that a Recording should be removed to protect the privacy of certain Users or because of violations of these Terms of Service. We will not use Recordings containing images of you (or your children) for promotional or any other purposes without your express written consent. By using the services, you consent to you and/or your child appearing in Recordings for the limited purposes set forth above.

Finally, we ask that all members assume the best intentions in others.  When something goes wrong, whether it's a technical glitch, an email without a response, or something else, we ask that you share feedback in a constructive way.

Payment Terms

 

General:

Each Parent agrees to pay all applicable membership fees for joining the Empowerment Hub (“Enrollment Fees”) as set forth on the Site. All Enrollment Fees are payable in the currency specified on the Site at the time of purchase. You shall be responsible for all local taxes in your country associated with the purchase of Planet Pilots Services. Parent hereby authorizes Planet Pilots to bill Parent’s payment instrument upon confirmation of a purchase, and Parent further agrees to pay any charges so incurred. If Parent disputes any charges you must let Planet Pilots know within sixty (60) days after the date that Planet Pilots charges you. Payments from individuals/families have to be processed through the PlanetPilots.org Site.

Teacher/School Payment: Planet Pilots will register payments to the purchasing school as well as to the Planet Pilot families that are invited to join by the teacher/school. Schools/institutions can request to pay invoices through bank transfer rather than by credit card.

Conditions of Use

 

User Conduct: You are solely responsible for all code, video, images, information, data, text, software, music, sound, photographs, graphics, messages or other materials (“content”) that you upload, post, publish or display (hereinafter, “upload”) or email or otherwise use via the Service. The following are examples of the kind of content and/or use that is illegal or prohibited by Planet Pilots. Planet Pilots reserves the right to investigate and take appropriate legal action against anyone who, in Planet Pilots' sole discretion, violates this provision, including without limitation, removing the offending content from the Service, suspending or terminating the account of such violators and reporting you to the law enforcement authorities. You agree to not use the Service to:

  • email or otherwise upload any content that (i) infringes any intellectual property or other proprietary rights of any party; (ii) you do not have a right to upload under any law or under contractual or fiduciary relationships; (iii) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; (iv) poses or creates a privacy or security risk to any person; (v) constitutes unsolicited or unauthorized advertising, promotional materials, commercial activities and/or sales, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” “contests,” “sweepstakes,” or any other form of solicitation; (vi) is unlawful, harmful, threatening, abusive, harassing, tortious, excessively violent, defamatory, vulgar, obscene, pornographic, libelous, invasive of another’s privacy, hateful racially, ethnically or otherwise objectionable; or (vii) in the sole judgment of Planet Pilots, is objectionable or which restricts or inhibits any other person from using or enjoying the Service, or which may expose Planet Pilots or its users to any harm or liability of any type;

  • interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service; or

  • violate any applicable local, state, national or international law, or any regulations having the force of law;

  • impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;

  • solicit personal information from anyone in violation of our Privacy Policy;

  • harvest or collect email addresses or other contact information of other users from the Service by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications;

  • advertise or offer to sell or buy any goods or services for any business purpose that is not specifically authorized;

  • further or promote any criminal activity or enterprise or provide instructional information about illegal activities; or

  • obtain or attempt to access or otherwise obtain any materials or information through any means not intentionally made available or provided for through the Service.

 

Special Notice for International Use; Export Controls: Software (defined below) available in connection with the Service and the transmission of applicable data, if any, is subject to United States export controls. No Software may be downloaded from the Service or otherwise exported or re-exported in violation of U.S. export laws. Downloading or using the Software is at your sole risk. Recognizing the global nature of the Internet, you agree to comply with all local rules and laws regarding your use of the Service, including as it concerns online conduct and acceptable content.

 

Commercial Use: Unless otherwise expressly authorized herein or in the Service, you agree not to display, distribute, license, perform, publish, reproduce, duplicate, copy, create derivative works from, modify, sell, resell, exploit, transfer or upload for any commercial purposes, any portion of the Service, use of the Service, or access to the Service. Request a Commercial Partner Agreement from Planet Pilots if you wish to add empowerment services to the Empowerment Hub or in other ways wish to partner through a commercial agreement.

Intellectual Property Rights

 

Service Content, Software, and Trademarks: You acknowledge and agree that the Service may contain content or features (“Service Content”) that are protected by copyright, patent, trademark, trade secret, or other proprietary rights and laws. Except as expressly authorized by Planet Pilots, you agree not to modify, copy, frame, scrape, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Service Content, in whole or in part, except that the foregoing does not apply to your own User Content (as defined below) that you legally upload to the Service. For the sake of clarity, you acknowledge and agree that Recordings constitute Service Content, not User Content. In connection with your use of the Service, you will not engage in or use any data mining, robots, scraping, or similar data gathering or extraction methods. If you are blocked by Planet Pilots from accessing the Service (including by blocking your IP address), you agree not to implement any measures to circumvent such blocking (e.g., by masking your IP address or using a proxy IP address). Any use of the Service or the Service Content other than as specifically authorized herein is strictly prohibited. The technology and software underlying the Service or distributed in connection therewith are the property of Planet Pilots, our affiliates, and our partners (the “Software”). You agree not to copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, or otherwise transfer any right in the Software. Any rights not expressly granted herein are reserved by Planet Pilots.

The Planet Pilots name and logos are trademarks and service marks of Planet Pilots (collectively the “Planet Pilots Trademarks”). Other Planet Pilots, product, and service names and logos used and displayed via the Service may be trademarks or service marks of their respective owners who may or may not endorse or be affiliated with or connected to Planet Pilots. All goodwill generated from the use of Planet Pilots' Trademarks is only for Planet Pilots' exclusive benefit.

Third-Party Material: Under no circumstances will Planet Pilots be liable in any way for any content or materials of any third parties (including users), including, but not limited to, for any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any such content. You acknowledge that Planet Pilots may, but is not required to, pre-screen content, and Planet Pilots and its designees will have the right (but not the obligation) in their sole discretion to refuse or remove any content that is available via the Service. Without limiting the foregoing, Planet Pilots and its designees will have the right to remove any content that violates these Terms of Service or is deemed by Planet Pilots, in its sole discretion, to be otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content.

 

User Content Transmitted Through the Service: With respect to the content or other materials you upload through the Service or share with other users or recipients (collectively, “User Content”), you represent and warrant that you own all right, title, and interest in and to such User Content, including, without limitation, all copyrights and rights of publicity contained therein. You shall retain any intellectual property rights that you hold in your User Content, and Planet Pilots does not claim any ownership (copyright, trademark, or otherwise) over your User Content. By submitting, posting, or otherwise uploading User Content on or through the Services you give Planet Pilots a worldwide, nonexclusive, perpetual, irrevocable, fully sub-licensable, royalty-free right and license as set below:

  • with respect to User Content that you submit, post, or otherwise make publicly or generally available via the Service (e.g. public forum posts), the license to re-post and publicly display such User Content (in whole or part) worldwide via the Services or otherwise;

 

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information about the Service (“Submissions”), provided by you to Planet Pilots are non-confidential and Planet Pilots will be entitled to the unrestricted use and dissemination of these Submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

You acknowledge and agree that Planet Pilots may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process, applicable laws or government requests; (b) enforce these Terms of Service; (c) respond to claims that any content violates the rights of third parties; or (d) protect the rights, property, or personal safety of Planet Pilots, its users and the public. You understand that the technical processing and transmission of the Service, including your content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to the technical requirements of connecting networks or devices.

 

Copyright Complaints: Planet Pilots respects the intellectual property of others, and we ask our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, you should notify Planet Pilots of your infringement claim in accordance with the procedure set forth below.

Planet PIlots will process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act (“DMCA”) and other applicable intellectual property laws with respect to any alleged or actual infringement. A notification of claimed copyright infringement should be emailed to Planet Pilots' Copyright Agent at hello@planetpilots.org (Subject line: “DMCA Takedown Request”). 

To be effective, the notification must be in writing and contain the following information:

  • an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;

  • a description of the copyrighted work or other intellectual property that you claim has been infringed;

  • a description of where the material that you claim is infringing is located on the Service, with enough detail that we may find it on the Service;

  • your address, telephone number, and email address;

  • a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law;

  • a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner’s behalf.

Counter-Notice: If you believe that your User Content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, to upload and use the content in your User Content, you may send a written counter-notice containing the following information to the Copyright Agent:

  • your physical or electronic signature;

  • identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled;

  • a statement that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content; and

  • your name, address, telephone number, and email address, a statement that you consent to the jurisdiction of the federal court chosen by Planet Pilots and a statement that you will accept service of process from the person who provided notification of the alleged infringement.

If a counter-notice is received by the Copyright Agent, Planet Pilots will send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member or user, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at our sole discretion.

Repeat Infringer Policy: In accordance with the DMCA and other applicable law, Planet Pilots has adopted a policy of terminating, in appropriate circumstances and at Planet Pilots' sole discretion, users who are deemed to be repeat infringers. Planet Pilots may also at its sole discretion limit access to the Service and/or terminate the memberships of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Third-Party Websites

 

The Service may provide, or third parties may provide, links or other access to other sites and resources on the Internet. Planet Pilots has no control over such sites and resources and Planet Pilots is not responsible for and does not endorse such sites and resources. You further acknowledge and agree that Planet Pilots will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any content, events, goods, or services available on or through any such site or resource. Any dealings you have with third parties found while using the Service are between you and the third party, and you agree that Planet Pilots is not liable for any loss or claim that you may have against any such third party.

Social Networking Services

 

You may enable or log in to the Service via various online third-party services, such as social media and social networking services like Facebook or Twitter (“Social Networking Services”). By logging in or directly integrating these Social Networking Services into the Service, we aim to make your online experiences simpler, faster, and more personalized. To take advantage of this feature and capabilities, we may ask you to authenticate, register for or log into Social Networking Services on the websites of their respective providers. As part of such integration, the Social Networking Services will provide us with access to certain information that you have provided to such Social Networking Services, and we will use, store and disclose such information in accordance with our Privacy Policy. For more information about the implications of activating these Social Networking Services and Planet Pilots' use, storage, and disclosure of information related to you and your use of such services within Planet Pilots (including, but not limited to, your friend lists), please see our Privacy Policy. However, please remember that the manner in which Social Networking Services use, store and disclose your information is governed solely by the policies of such third parties, and Planet Pilots shall have no liability or responsibility for the privacy practices or other actions of any third-party site or service that may be enabled within the Service.

In addition, Planet Pilots is not responsible for the accuracy, availability, or reliability of any information, content, goods, data, opinions, advice, or statements made available in connection with Social Networking Services. As such, Planet Pilots is not liable for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such Social Networking Services. Planet Pilots enables these features merely as a convenience and the integration or inclusion of such features does not imply an endorsement or recommendation.
